Some info on image usage and copyright for any one hiring photographers for real estate, interior design, or other like services.

Basic industry standard terms for Real Estate licenses:

- Usage permitted only by the original paying agent/brokerage and no other offices.

- Use while listing is active and just after closing to celebrate.

- Permitted on MLS, listing sites, personal business page and agent's social media and website promoting the active listing, brochures for open houses. Long term use to promote your business (like on page banners) will need a separate Commercial Usage License.

- When a third party (brokerage/agent/builders/stager, etc) wishes to use the photos / are already using them without permission, report or direct them to the photographer who owns the copyright (Intellectual property) to purchase the appropriate license.

- Typically, the original agent should give their blessings as well for other real estate agents use, but photographers as copyright holders of their intellectual property do ultimately have the rights to sell licenses to other parties.

- Paying client only has permission to use photos and do not own the images. They are not to give or sell to others.

RE photo licenses are extremely cheap compared to other uses as the value is short-lived and ultimately only need one person to buy a home.

Example: Contractors wishing to use photos on their website and brochures to ongoingly attract potential business will pay anywhere between $125-$500 per photo based on a variety of factors. Interior designers and companies can pay $600-$4000 as a creative fee for just the shoot and pay separately per image. It all depends on the value of the image relative to the usage.

Ten months later and we’re still thinking about this gorgeous property rental we shot in Stowe last summer. This is a property for the books, and has so much style between the 18th century architecture and the modern flair brought in by designers. Plenty of gorgeous antique pieces and original are in the space, it is truly a special place to spend time with some family. Just a minute or so from downtown still, this rental is the perfect place to truly relax, explore, feel home away from home while being so close to all the amenities that still has to offer.
